Terms & Conditions
Definitions
- Canada Atlantic Caregiving Solutions, a live in - live out caregiver placement agency referred hereafter as "Canada Atlantic", is registered to conduct business under the laws of the province of New Brunswick, Canada.
Employer, referred hereafter as "Employer", as used for the purposes of the following terms and conditions means the person(s) who have engaged Canada Atlantic to assist in the placement of a live in caregiver provider and who will ultimately hire the live in caregiver provider candidates.
Caregiver Provider, referred hereafter as "Caregiver" as used for the purposes of the following terms and conditions, means the person(s) who wishes to be hired by an employer.
General Terms and Conditions
- The parties agree and acknowledge that any Caregiver hired by Employer will be an employee of the Employer. Canada Atlantic will not be a party to any employment agreement or contract between the Employer and the Caregiver candidates submitted by Canada Atlantic to the Employer.
All hiring decisions will be made solely by the Employer. All liability associated with the hiring decision will be assumed by the Employer.
Under no circumstances will the Employer have the right to make any direct claims of any kind against Canada Atlantic, its officers, directors, shareholders, employees or agents related to the performance, acts or omissions of the Caregiver.
The Employer will not disclose to any third party information regarding any and all Caregiver candidates, including names and phone numbers provided by Canada Atlantic. The Employer expressly acknowledges that the information prepared and provided by Canada Atlantic is confidential in nature and at all times is proprietary information owned by Canada Atlantic.
Likewise, Canada Atlantic will not disclose to any third party, other than as necessary to perform pursuant to these terms and conditions, any personal or identifying information provided to Canada Atlantic by the Employer.
Information provided to the Employer from Canada Atlantic is solely for the purpose of selecting a Caregiver pursuant to these terms and conditions. Under no circumstances will the Employer have the right to contact the Caregiver candidates directly for the purpose of referrals to a third party or future live in caregiver searches.
The Employer agrees to forever indemnify, release and hold harmless Canada Atlantic, its agents, employees and officers for any and all claims relating to the services provided by the Caregiver.
Services Provided By Canada Atlantic
Canada Atlantic will assist the Employer in the following:
- Search for an exceptable Caregiver candidate.
Obtain work history, resume and application of prospective Caregiver.
Obtain interview with prospective Caregiver.
Completion of Employment Contract. (Canadian Citizen or Foreign National With Open Permit)
Responsibilities Of Employer
Employer agrees and understands that Caregiver must:
- Work for Employer in a private home.
In the case of a live in caregiver, Live in with Employer.
In the case of a live in caregiver, be provided with a private and furnished room within the home.
In the case of a Canadian or foreign live in caregiver, be employed on a full-time basis.
Employer agrees with the following:
- To abide by employment standards in the province in which Employer resides and Caregiver is to work.
In the case of a foreign live in caregiver, to provide costs to transport Caregiver to the Employer home in Canada.
In the case of a foreign live in caregiver, as soon as possible after Caregiver arrives at Employer home, to assist Caregiver to obtain a Social Insurance Number as well as Provincal Medical Insurance.
In the case of a foreign live in caregiver, as soon as possible after the Caregiver arrives at Employer home, the Employer agrees to enroll the Caregiver, at no cost to the Caregiver, in provincial workplace safety insurance (also known as worker's compensation) or comparable insurance if the former is not available.
In the case of a foreign live in caregiver, to provide health insurance, at no cost to the Caregiver, begining at the time of arrival at the Employer home and until Caregiver become eligible for provincial health coverage.
To withhold income tax, Canada Pension contributions and Employment Insurance premiums from Caregiver's salary and submit income tax, contributions and premiums to the Canadian Revenue Agency on a monthly basis.

Trial Period
A trial period of (10) weeks will apply for the Caregiver the Employer accepts as a result of the services of Canada Atlantic. The purpose of this trial period will be to ensure that the Employer and the Caregiver are a good match. If it is found during this trial period that, after all the best efforts of the parties, there is no compatability between the Caregiver and Employer, Canada Atlantic will replace the Caregiver by another caregiver candidate. If the replacement caregiver comes from abroad, the Employer agrees to pay the transportation cost of the replacement Caregiver. The Employer agrees there will be only (1) one replacement. If the working relationship, between the Employer and the Caregiver, ends because of the Employer misrepresentation of the employment contract, any mistreatment or abuse by the Employer or hours worked and didn't compensate the Caregiver for the time worked, the agreement to the replacement of the Caregiver becomes null and void.
Termination of Canada Atlantic Obligations
Canada Atlantic obligations to Employer will terminate after trial period ends.
